Terms of Service

Last updated: January 5, 2025

These Terms of Service ("Terms") govern your access to and use of dndcharactercreator, our AI-powered character creation tools, and any related websites, emails, or services (collectively, the "Service"). By creating an account, upgrading a subscription, or using the Service in any way, you agree to these Terms.

1. Who we are

The Service is developed and operated by an independent creator based in the United States operating under the name dndcharactercreator ("we", "us", or "our"). We rely on Creem as the Merchant of Record for paid subscriptions and Better Auth for account authentication.

Questions about these Terms can be sent to support@dndcharactercreator.art.

2. Eligibility and accounts

You must be at least 16 years old to use the Service. If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

We may suspend or terminate access if we believe your account has been compromised, is used in violation of these Terms, or is otherwise creating risk for other users.

3. Subscriptions and billing

Free trials: each new account starts on a limited trial with text quotas. Trial features may change without notice.

Paid plans: when you upgrade, you authorize Creem to charge the payment method you provide for the selected plan (Starter, Pro, or Studio) and billing cycle (monthly or yearly). Prices are shown in USD unless stated otherwise.

Renewals: subscriptions renew automatically until canceled. If payment fails or the plan expires, we may downgrade your membership to the free tier.

4. Cancellation and refunds

You can cancel anytime through the Creem Customer Portal or by emailing support@dndcharactercreator.art from the address tied to your account. Cancellation stops future renewals but does not retroactively refund previous charges unless required by law.

Refund requests: contact us within 14 days of a charge if something went wrong. We aim to reply within 3 business days. If we do not respond in time, Creem may process a refund on our behalf to protect customers.

Quota usage: consumable credits or portrait quotas that were already used before cancellation are not refundable.

5. Acceptable use

You may not use the Service to produce or distribute content that is illegal, infringing, deceptive, hateful, or harmful, or to reverse engineer, scrape, or exploit our systems. You are responsible for the stories, art prompts, or other inputs you provide.

We reserve the right to disable any account that violates these rules, creates excessive infrastructure load, or fails Creem's risk review.

6. AI-generated content

Outputs are generated by third-party AI providers (such as SiliconFlow, OpenAI, or similar). Generated stories, art descriptions, and stats are provided "as is" and may contain errors, bias, or fictional elements. You should review and edit any content before using it in play or publishing it to others.

You are solely responsible for complying with any applicable intellectual property or content policies when you reuse generated assets.

7. Intellectual property

We retain all rights, title, and interest in the Service, including custom UI, prompts, templates, and underlying software. You retain rights to your own prompts and to the characters you export, subject to any restrictions imposed by the underlying model providers.

The Dungeons & Dragons trademarks belong to Wizards of the Coast LLC. We are not affiliated with or endorsed by Wizards of the Coast.

8. Third-party services

The Service relies on third parties such as Creem (payments), Better Auth (authentication), and analytics providers. We are not responsible for outages or issues caused by those services but will work in good faith to resolve disruptions.

Your use of third-party services may also be governed by their own terms and policies.

9. Disclaimers and liability

The Service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, and we will not be liable for any indirect, incidental, punitive, or consequential damages arising from your use of the Service.

Our total liability for any claim will not exceed the amount you paid for the Service in the 12 months preceding the event giving rise to the claim.

10. Changes to these Terms

We may update these Terms to reflect product changes, legal requirements, or security needs. Material changes will be announced via the website or email. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
